Terms & Conditions for Lending Program
1. Application of Terms
These terms and conditions (“Terms”) are applicable to and govern your participation in the BONDS by IQOS lending program (“Lending Program”) which allows the legal age smoker or user of other nicotine products, who resides in Lebanon (“Participant”) to try BONDS by IQOS for the maximum duration of 14 days. (“Lending Period”).
You should read these Terms carefully as they affect your legal rights and govern your relationship with Philip Morris Management Services (Middle East) Limited-Lebanon Branch (“PMMS Lebanon” and its affiliates (“We” or “PMMS”).
By participating in the Lending Program, in which a BONDS by IQOS device (as defined below) will be lent to you by our authorized IQOS field coaches, you agree to be bound by these Terms. If you do not agree or cannot comply with these Terms, then you are not permitted to participate in the Lending Program. No modification of these Terms by you is permitted unless PMMS expressly agrees in writing.
We also reserve the right to amend the terms at any time at our discretion.
2. Eligibility:
You are only eligible to participate in the Lending Program, if you satisfy the following conditions:
- You are a smoker or user of IQOS or other nicotine products, aged over 18 years old.
- Your main residence is in Lebanon, and you are a registered user in our database.
- You do not have any current open Lending Program cases.
- You have never bought the current BONDS by IQOS product on offer for lending (“BONDS by IQOS Device”), from any of our authorized touchpoints or website(s) and do not have any linked BONDS by IQOS Device with the same generation on offer or lending, in our database; Any Participant can benefit from the Lending Program one (1) time only or whenever a new generation of the BONDS by IQOS Device is available.
- You must pay for the three (3) BLENDS packs as mentioned in the section below. The Payment must be done by cash to our authorized IQOS field coach prior to the start of the lending period.
3. Start of Lending Period
Participant is considered to have completed his/her Lending Program when these steps have been completed:
The Participant decides to enter the Lending Program upon which he/she is given a BONDS by IQOS Discovery Bundle Box from one of our authorized IQOS field coaches which includes the BONDS by IQOS Device, three packs (3) of the desired BLENDS flavors, and a Charging Cable. The Participant can do a Guided Trial with our authorized IQOS field coach to better assist him/her in choosing the flavor that could provide the best BONDS by IQOS experience. The Participant will be immediately charged the value of the three (3) BLENDS packs at the conclusion of the interaction through a cash payment to an authorized IQOS field coach.
4. End of Lending Period:
At the end of the Lending Period, you should provide us with your final decision to purchase or return the BONDS by IQOS Device. The company reserves the right to change the value at any time of the three (3) BLENDS packs associated with this Lending Program, and the value and type of any other reward or promotion offered to Lending Program Participants, upon notification.
If you choose to purchase a BONDS by IQOS Device after the lending period is over, you must return the device you received for the Lending and will be given a brand-new BONDS by IQOS Device, which you will pay for through a cash your authorized IQOS field coach.
You may end the Lending Program at any time prior the end of the Lending Period, by contacting your IQOS field coach who authorized the lending.
After every Lending, regardless of the decision to purchases a device or not, The BONDS by IQOS Device must be returned as per the following conditions:
- The BONDS by IQOS Box, BONDS by IQOS Device, and Charging Cable are all accounted for and returned.
- All items that are returned are the same items that were given to the Participant at the start of the Lending Program (the BONDS by IQOS Device and Box’s barcodes are the same barcodes that were given to the Participant at the start of the Lending Program).
- BLENDS Packs purchased by the Participant may not be returned nor refunded, even if they are still sealed.
- In the event that an item is missing, we will be reaching out to the Participant to organize another day for pickup of the remaining item(s).
- All the items must be returned within fourteen (14) calendar days from the start of the Lending Period. After fourteen (14) days have passed, the device will be flagged as un-returned, and the Participant profile will be flagged. This will deny the Participant any access to any IQOS services and privileges across all categories and devices.
- Returns of all BONDS by IQOS Devices are initiated by the Participant by contacting the IQOS field coach that authorized the lending to arrange a courier pickup at your place of convenience. Returns for the Lending Program cannot be done in our physical touchpoints.
5. Social Media
We kindly ask you not to provide any testimonials/endorsements on your private social media accounts and not to promote or advertise Philip Morris Brands on social and other digital media.
6. Laws & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of The Republic of Lebanon. You irrevocably submit to the exclusive jurisdiction of the courts of Beirut, Lebanon for disputes arising from or related to these Terms.
7. Indemnification
PMMS not be liable to the maximum extent permitted under applicable law whether in tort (including for negligence or breach of statutory duty), contract, misrepresentation, restitution or otherwise for any direct losses, loss of profits, sales, revenues or savings, loss of business, depletion of goodwill and/or similar losses or loss or corruption of data or information, or pure economic loss, or for any special, indirect or consequential loss, costs, damages, charges or expenses however arising or otherwise resulting from your participation in the Lending Program.
8. General Terms:
- PMMS neither seeks nor expects to directly or indirectly (i) receive, in return for your participation in the Lending Program, any specific favor or concession, including obtaining or retaining business or any improper advantage for itself or any of its affiliates, now and in the future, or (ii) to improperly influence your independent business judgment.
- We reserve the right to amend the terms and conditions and/or suspend and terminate the Lending Program at any time. We also reserve the right to exclude a Participant from the Lending Program at any time without cause.
- Creating multiple accounts with the intent of benefiting from additional Lending Programs or otherwise, is not allowed. In the case that we discover intentional or suspected fraud, we reserve the right to terminate the Participants’ account.
- You shall not be considered nor hold itself out to be, an agent, employee or partner of PMMS for any purpose and is not authorized, nor shall it purport to be authorized, to create obligations binding on PMMS in any manner whatsoever.
- Use of personal data: When you participate in the Lending Program, PMMS will use data about you as described in its privacy notice, available here: https://lb.iqos.com/en/legal#privacy-notice. This use includes sharing data about you with affiliates of PMMS, and to other service providers, in each case which may be either in the same country as you, or in other countries. Our affiliates, and our and their service providers are in many countries throughout the world, including in particular the EEA, Switzerland, the USA, Canada, India, the Philippines, Indonesia, and Australia. In all cases, appropriate security measures for the protection of personal data will be applied in those countries or territories, in accordance with applicable data protection laws. We implement appropriate technical and organizational measures to protect personal information that we hold from unauthorized disclosure, use, alteration or destruction. Where appropriate, we use encryption and other technologies that can assist in securing the information you provide. We also require our service providers to comply with strict data privacy and security requirements.
