IQOS CLUB Terms and Conditions
1. Overview of IQOS CLUB
1.1 IQOS CLUB is a status-based program for Legal Age Users (“LAU(s)”) of IQOS products, meeting the requirements of these Terms. Through IQOS CLUB you are able to collect Points by taking certain actions, and in return we at our own discretion offer you Benefits including one-of-a-kind events and experiences, a chance to win prizes, get special offers in return of purchasing IQOS products.
2. Application of Terms
2.1 These terms and conditions (“Terms”) are applicable to and govern your
participation in the IQOS CLUB program (“IQOS CLUB”). You should read these
Terms carefully as they affect your legal rights and govern your relationship
with Philip Morris Management Services (Middle East) Limited – Lebanon branch
(Philip Morris) and the IQOS CLUB.
2.2 If you do not agree (or cannot comply) with these Terms, then you are not
permitted to participate in IQOS CLUB.
2.3 You agree to be bound by these Terms by:
- Registering for IQOS CLUB pursuant to paragraph 4.1
- Registering at least one Device under IQOS CLUB
- Using Benefits of IQOS CLUB
If you register more than one Device, you will still only have one IQOS CLUB
membership. If we change these Terms, and you then use Benefits of IQOS CLUB,
or you register another Device, you agree to be bound by the changed Terms.
2.4 When registered and enrolled in the IQOS CLUB pursuant to paragraph 4.1,
you are accepting the Terms in the version valid at the time of your
registration and enrolment. Your acceptance of these Terms is deemed to occur
in the country of your registered residence as per our IQOS database.
2.5 We reserve the right to amend these Terms and the mechanics, Benefits of
IQOS CLUB at anytime. If you do not agree to any such amendments, you may
terminate your membership of IQOS CLUB.
2.6 No modification of these Terms by you is permitted.
3. Eligibility
3.1 You are only eligible for membership of IQOS CLUB if:
- you are a LAU of IQOS, aged 18 years old and above and registered in our IQOS database as an owner of a Device
- your main residence is in Lebanon.
3.2 IQOS CLUB membership is only open to natural living persons. Companies,
partnerships, unincorporated associations and other legal entities are not
eligible for membership.
3.3 A member of IQOS CLUB may not have multiple memberships. You must maintain
only one account in the IQOS CLUB.
4. Registration and Enrollment
4.1 You will be automatically registered and enrolled into the IQUS CLUB as a
member if you are registered in our data base as a Device owner or if you
purchase a Device during and post the program launch, your account setting has
to be “Marketing Opt-In”. If you were not automatically registered because you
have set your account as “Marketing Opt-Out” you can register by resetting
your account to “Marketing Opt-In”; you must register at least one Device in
our database.
You can register the Device:
- At iqos.com and clicking ‘I Agree’ or a similar button to participate in the IQOS CLUB
- By calling the customer service center at 1245
- Through a Philip Morris IQOS coach
- At an authorized IQOS store
4.2 You are able to register any IQOS device that has been introduced in the
market from IQOS launch in Lebanon (“Device(s)”), If applicable, any future
IQOS Devices which qualify you for membership to IQOS CLUB.
4.3 Registration may take place at any time provided you are an LAU of a
Device. In completing the registration process you must provide all required
mandatory information in an accurate and complete manner and keep this
information up-to-date. If you do not complete the mandatory fields in the
application form (such as, for example, age, smoker status, email address
and/or phone number) your application will not proceed. If you provide
inaccurate or incomplete information Philip Morris reserves the right to
terminate your membership of IQOS CLUB without notice.
4.4 Following the registration and enrolment process for IQOS CLUB you will be
informed whether your registration and/or enrolment is successful. Membership
of IQOS CLUB and Benefits it provides are personal to you, and may not be
transferred to any third party. You may opt-out of IQOS CLUB Program at any
time.
4.5 IQOS CLUB is only available in certain countries. Your use of IQOS CLUB is
linked to your country of residence. If you change your country of residence,
then your membership in that country automatically expires and you must inform
us and reapply to use IQOS CLUB in your new country of residence (if IQOS CLUB
is available in that country).
4.6 There is no legal right to register and enroll in the IQOS CLUB Program.
Philip Morris may refuse admission to the IQOS CLUB at any time without
indicating reasons. Philip Morris may also terminate IQOS CLUB program at any
time without any liability.
5. Benefits
5.1 As a result of your membership to IQOS CLUB and based on your Status Level and
collected Points you will be entitled to the benefits listed on the IQOS CLUB
benefits page (“Benefits”), see here
Benefits.
In addition to the Benefits Listed on the IQOS CLUB benefit page, we would on
an ad hoc basis offer selectively and voluntarily other privileges and
benefits.
5.2 You may receive Benefits through the collection of Points and reaching
different Status Levels. The process for earning Points is described in
paragraph 6. The choice of Benefits you may receive, are subject to their
availability.
5.3 Only you may request Benefits based on your Status Level. Benefits may only be
used by you unless the specific Benefit expressly provides for other persons
to use it.
5.4 Benefits must be used during the term of your Status Period, alternatively and
if applicable, within the time period attached to the Benefit. Benefits not
used within the given period shall expire. Failure to utilize a Benefit which
is booked for a specific date or time will result in the Benefit being
cancelled.
5.5 Some Benefits may be provided by our service partners (“Service Partners”).
Benefits from Service Partners may be subject to the Service Partner’s terms
and conditions. Philip Morris will use reasonable efforts to ensure the
availability of such Benefits, but will not be liable for any loss arising
from the failure of a Service Partner to provide such Benefit except where
such failure is caused by Philip Morris. In such case, the liability of Philip
Morris shall be limited to the monetary value of the Benefit, subject to the
limitations provided in the Terms.
5.6 Philip Morris reserves the right to:
- Discontinue relationships with Service Partners and access to such Benefits for any reason at any time.
- To modify the Benefits at any time for any reason.
Upon any such change Philip Morris will notify you, for example through updates on the IQOS CLUB section of the IQOS website.
6. Points
6.1 Under the IQOS CLUB, you can collect points (“Status Points”) also referred to
as (“Points”) as the case may be. Status Points determines your status level
as a member (“Status Level”). It is exclusively when a deviation has been
communicated that it will be possible to do an activity multiple times and
obtain the corresponding Points multiple times. Status Points can only be
earned by a member directly and are not transferable to other IQOS CLUB
members.
6.2 As a member of IQOS CLUB, you are able to earn Status Points through
predefined activities as described in the following:
Transactional Based Points Earning
- Join IQOS Club
- Device purchase
- Accessories purchase
- Functional Tools purchase
- At least 1 recorded transaction per month which is the first transaction performed per month
- Points Multiplier offered voluntarily on an ad-hoc basis
Engagement Based Points Earning:
- Complete Survey
- Learn about IQOS [ educational based article, video, quiz
- User Generated Content incentivization
6.3 Status Points are automatically credited when a member identifies himself or
herself during an activity. User identification can be performed via user
login. Points are recorded by Philip Morris in your membership account which
can be accessed via the IQOS.com website as well as in the user profile, and
are credited to your IQOS CLUB account soon after being earned.
6.4 The number of Points earned per activity may depend on your Status Level
and/or the type of activity.
6.5 Your Status Level will be evaluated every three (3) months
(“Status Qualification Period”), at the end of each Status Qualification
Period your Points return to zero. Progression is from Silver to Gold, Gold to
Platinum (and vice versa), depending on the number of Points accumulated in a
Status Qualification Period.
6.6 In case of any dispute about
entitlement to Points, Philip Morris may require you to provide proof of
performance of the action for which you claim Points. Claims must be received
by Philip Morris within six (6) months of the action.
6.7 Points can
only be earned by you and may not be transferred to another member or any
third party.
6.8 Points are not exchangeable for cash.
6.9 Points may not be used with any other status or loyalty program.
6.10 Philip Morris may at its discretion change the rules for earning
Points upon notice at any time.
Status Level
6.11 IQOS CLUB has three Status levels: Silver, Gold, and Platinum (Status Level).
Your Status level determines the Benefits that you are entitled to as a member
of IQOS CLUB.
6.12 When you join IQOS CLUB you will automatically be given Silver
status for your first Status Level Period.
6.13 The number of Points
you earn in each Status Qualification Period determines your Status Level for
the next Status Period. At the end of the first Status Qualification Period
and every subsequent Status Qualification Period your Status Level is reviewed
by Philip Morris and will be updated according to the number of Points and
number of transactions you have accumulated and completed in the Status
Qualification Period. The number of Points needed for each Status Level and
Level promotion, maintenance and demotion is described in the FAQ section in
the bottom part of the following page here [FAQ]. Philip Morris may at its
discretion change the number of Points needed for each Status Level upon
notice at any time.
7. Your Obligations
You agree:
- not to misuse the IQOS CLUB program, including its Benefits;
- not to obtain Points or Benefits by fraud;
- to treat our staff and those of our Service Partners with courtesy and respect;
- to keep your membership account, including its password, safe and secure;
- to comply with applicable law; and
- to comply with these Terms.
8. Data Privacy/Communications
8.1 Philip Morris will receive, store, and otherwise process your personal information in connection with administering the IQOS CLUB and your participation in it. To learn how we will use your personal information collected in connection with your IQOS CLUB account, read the Philip Morris Privacy Notice at https://www.pmi.com/privacy-notice. For the full Benefits of IQOS CLUB you will receive communications from IQOS CLUB regarding the program.
9. Termination and Opt-Out
9.1 The term of your membership in IQOS CLUB is from the date of joining to IQOS
CLUB and continues until termination of your membership according to the
Terms.
9.2 You may terminate your membership of IQOS CLUB at any time with
immediate effect by notifying Philip Morris through our call center on 1245 or
chatting with our agents on our official website

9.3 Philip Morris may
terminate your membership with IQOS CLUB at any time with immediate effect if
you breach these Terms. In addition, Philip Morris may terminate your
membership for any reason after providing you with a written notice.
9.4 Philip Morris may terminate your membership with IQOS CLUB based
on general housekeeping rules pertaining to data privacy management in case
your account hasn’t been active for the last 36 months.
9.5 Upon
termination of your membership of IQOS CLUB, you are no longer entitled to
receive any of the Benefits of IQOS CLUB, any unused and Benefits are
cancelled automatically and your membership data (including the number of
collected Points, your Status) are permanently deleted from IQOS internal
systems.
9.6 You may opt-out of IQOS CLUB membership at any time. If
you choose to opt-out, you will not be able to access IQOS CLUB pages, collect
Status Points and use other Benefits. Philip Morris will store your membership
data and in case you decide to opt-in in the future, your membership data will
be restored. Your Status Level, Status Points and Benefits will no longer be
valid.
9.7 Your membership in IQS CLUB will be automatically
terminated in case no Devices are registered on your account anymore.
10. Warranty/Representation/Limitation of Liability
10.1 As your membership of IQOS CLUB is free of charge, it is provided ‘As Is’ and
without any warranty.
10.2 Philip Morris makes no representations as to any income, use,
excise or other tax liability you may incur as a result of your membership of
IQOS CLUB. You are advised to check with your accountant or tax adviser for
further information, and are solely responsible for any tax liability incurred
as a result of your membership of IQOS CLUB, or receipt of Benefits.
10.3 Philip Morris shall not be liable to the maximum extent permitted
under applicable law whether in tort (including for negligence or breach of
statutory duty), contract, misrepresentation, restitution or otherwise for any
direct losses, loss of profits, sales, revenues or savings, loss of business,
depletion of goodwill and/or similar losses or loss or corruption of data or
information, or pure economic loss, or for any special, indirect or
consequential loss, costs, damages, charges or expenses however arising or
otherwise resulting from your membership of IQOS CLUB or your use of any of
the Benefits related to the IQOS CLUB. Philip Morris shall not be liable for
any of the losses described in this paragraph 10.3 even if you have informed
Philip Morris of the possibility of such losses.
10.4 Nothing in this
paragraph 10 excludes any liability that cannot be excluded by applicable law.
11. Ownership and Risk
11.1 Ownership of Points and Benefits remains with Philip Morris at all times and
never passes to you. You have a right to use Benefits in accordance with these
Terms.
11.2 Risk in Benefits passes to you as soon as you redeem a Benefit.
12. Non-Transferability
12.1 Other than as specifically notified by Philip Morris for a particular Benefit
in writing, Points and Benefits are not redeemable for cash, refundable or
exchangeable. At no time may Points, and Benefits be purchased by, sold to,
bartered or otherwise transferred to any third party including any other
member unless specifically authorized to do so. Philip Morris may cancel any
Points, and Benefits dealt with in this way.
12.2 Any attempted sale or transfer of Points or Benefits contrary to
these Terms is a material breach and will automatically result in the
termination of your membership.
13. Miscellaneous
13.1 For questions, enquiries and contact information about IQOS CLUB please

13.2 Philip Morris reserves the right to suspend or discontinue the
eligibility of you or any person who uses, or, in the case of suspension, is
suspected of using, IQOS CLUB in a manner inconsistent with these Terms or
applicable law. In addition to suspension or discontinuance of IQOS CLUB
eligibility, Philip Morris shall have the right to take appropriate
administrative and/or legal action, as it deems necessary in its sole
discretion.
13.3 Philip Morris’s failure to enforce these Terms shall
not constitute a waiver of these Terms, or any of its provision.
13.4 Accumulation of Points, s and Benefits is determined by Philip
Morris in its sole discretion.
13.5 Upon the death of any member, any
Points, and Benefits accumulated by that member are automatically
cancelled.
13.6 All questions or disputes regarding eligibility for the
IQOS CLUB, the availability of Benefits, or your compliance with these Terms
will be resolved by Philip Morris in its sole discretion. The decision of
Philip Morris shall be binding.
13.7 Philip Morris is not responsible
for any incorrect or inaccurate information supplied by you while
participating in IQOS CLUB, nor for any lost or misdirected communications to
or from you regarding the IQOS CLUB, unless they were provided by Us.
13.8 You are responsible for maintaining updated contact information on
your IQOS CLUB account.
13.9 Notices by Philip Morris hereunder may be
made in writing including by email or through an announcement on our website.
13.10 These Terms are subject to the laws of the registered office of
Philip Morris. Any legal dispute will be subject to the exclusive jurisdiction
of the city in which Philip Morris has its registered office.
13.11 Any
provision of these Terms declared void or unenforceable by any competent
authority or court shall, to the extent of such invalidity or
unenforceability, be deemed severable and shall not affect the other
provisions remaining which shall continue unaffected.
13.12 If there is
any conflict in meaning between the English language version of these Terms
and any version or translation of these Terms in any other language, the
English language version shall prevail.
